Course Description

1. Navigating Canada Revenue Agency (“CRA”) Audits

This seminar will discuss best practices for representing your clients during CRA audits. Generally, the following topics will be discussed:

  • the CRA’s administrative power and its limits to demand information from taxpayers;
  • the CRA’s typical audit procedures;
  • the CRA’s various audit methods;
  • the CRA’s various audit methods; speciality audits, such as group audit projects and the offshore compliance team;
  • common mistakes made by tax advisors;
  • when CRA audits are referred to CRA enforcement (criminal investigations); and,
  • what can be done when CRA auditors are uncooperative or acting improperly.

Peter Baek

Peter's practice focuses on troubleshooting tax problems with a particular emphasis on CRA audits, objections and Tax court appeals but also helps clients with tax planning and structuring matters. He is qualified as both a chartered accountant (CPA CA) and a lawyer, and has been practicing tax as an accountant/lawyer for over 20 years. Prior to pursuing his law degree, Peter worked as a senior tax auditor at the CRA for 2½ years where he audited companies with up to $1 billion in revenue. Peter has extensive experience representing and counseling clients in tax controversy matters. Drawing upon his experience as a CRA tax auditor, CPA CA and lawyer, Peter has achieved significant tax savings for his clients in numerous tax matters at various levels of the tax administration process from tax audits to tax court appeals.

Igor Kastelyanets

Igor Kastelyanets was called to the bar in Ontario in 2014 and has substantial experience in the field of taxation. Igor has appeared at the Tax Court of Canada and the Federal Court of Appeal. He is a member of the executive committee of the Ontario Bar Association, Young Lawyers Division Continuing Legal Education Committee.

Duane Milot

Duane has been advising individuals, small businesses and multi-national entities on a variety of tax issues since his call to the Ontario Bar in 2003.

After gaining close to 9 years of experience working for large Bay Street law firms, Duane opened his own tax boutique firm in 2011 where he is able to provide quality tax advice, at reasonable rates.

During his career, he has been involved in some of the most complicated and high profile transactions in Canada, and participated in several ground-breaking tax litigation cases. Having been trained and mentored by some of Canada’s best lawyers, he brings a unique perspective and varied experience to his practice.
